PicPhoto Terms of Service

1. Acceptance of Terms
By accessing or using PicPhoto—including ai-photogenerator.org, and any mobile experiences—you agree to these Terms of Service and our Privacy Policy. If you are acting on behalf of a company or organization, you represent that you have the authority to bind that entity.
2. Service Overview
PicPhoto delivers commerce-focused AI workflows: AI Product Photography, Background Remover, Image Upscaler, Magic Eraser, Batch Photo Editor, plus Solutions templates for Amazon Sellers, Fashion & Apparel, and Social Media teams. We are not affiliated with Amazon, Shopify, Temu, Etsy, Meta, or any other marketplace; we only provide tools that help you create compliant assets faster.
PicPhoto is an independent AI service powered by Nano Banana/Stable Diffusion. We are not affiliated with the model creators and only use their technology stack to deliver outputs you initiate.
3. Eligibility & Accounts
- You must be at least 13 years old (or older if required in your jurisdiction) and able to enter into a binding contract.
- Provide accurate name, email, and organization/store information during registration and keep it current.
- You are responsible for safeguarding account credentials, API keys, and generated data. Notify support@ai-photogenerator.org immediately of any unauthorized use.
4. License & Ownership
- You retain ownership of the assets you upload and the outputs you generate. You grant PicPhoto a non-exclusive, worldwide, royalty-free license to use that content solely to operate the Service and, if you explicitly opt in, to train or fine-tune quality-assurance models.
- PicPhoto (and its suppliers) own the platform, templates, model weights, UI, documentation, and derivatives. Unless a separate written agreement states otherwise, you may not copy, sell, or build competing services on top of our platform.
5. Pricing, Plans & Credits
- PicPhoto uses subscriptions plus credits. Free trials, credits measure generation volume and any credits already consumed are not reinstated even if a refund is approved.
- By upgrading, renewing, or purchasing add-on credits you authorize us or our processor to charge the payment method on file. Failed payments may result in suspension.
- Prices are shown on the checkout page and exclude applicable taxes, duties, or exchange fees.
- If you are not satisfied, you may request a refund for subscriptions or add-on credits within seven (7) calendar days of the original purchase by emailing support@ai-photogenerator.org with the subject line “Refund Request,” your order ID, account email, and a brief explanation. We acknowledge your request and deliver a decision with an email reply within three (3) business days. Refunds are prorated based on unused credits or remaining service time at the published plan price; any credits or services you already consumed are deducted from the refund amount. After the seven-day window—or once credits are exhausted—fees become nonrefundable unless required by law.
- Verified technical failures, duplicate charges, or mandatory compliance notices (for example, marketplace takedowns or GDPR withdrawal requests) are eligible for refunds outside the seven-day window when you supply supporting evidence. We apply the same prorated calculation described above. Additional details sit inside the dedicated Refund Policy.
6. Acceptable Use
You and your end users must not:
- Upload or generate content that infringes privacy, intellectual property, or publicity rights.
- Use PicPhoto to create illegal, hateful, NSFW, pornographic, or deceptive advertising material.
- Reverse engineer, circumvent security, scrape at scale.
- Resell the Service, share accounts, or provide automated bulk access without written permission.
- Upload legally protected health or financial records unless you are authorized to do so and apply the required safeguards.
7. High-Risk Activities & Output Accuracy
AI-generated scenes, backgrounds, and copy may contain errors or fall short of evolving marketplace rules. You are solely responsible for reviewing outputs before publishing and ensuring compliance with Amazon, Shopify, FDA, FTC, EU, or other regulators. PicPhoto is not liable for losses arising from reliance on generated content.
8. Integrations & Marketplaces
If you connect third-party platforms (Amazon S3, Shopify, Meta Ads, cloud storage, DAM, etc.) you must follow their terms. You allow PicPhoto to exchange the materials, SKUs, or statistics necessary to complete the actions you initiate.
9. Privacy & Data Processing
Our data practices are described in the Privacy Policy. Using the Service means you consent to PicPhoto collecting and processing personal data—including logs for abuse prevention and experience optimization—per that policy.
10. Term, Suspension & Termination
- These Terms remain in effect while you maintain an active account and stay current on payments.
- We may suspend or terminate the Service immediately if you breach the Terms, create risk for the platform, or if we receive third-party complaints. We will explain the reason when practical.
- After termination we delete or anonymize account-related data according to the Privacy Policy’s retention schedule. Fees already paid and remaining credits are refundable only when your case meets the seven-day satisfaction guarantee, the prorated rules in the Refund Policy, or applicable laws mandate reimbursement; otherwise they remain nonrefundable.
11. Disclaimer
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or noninfringement. We do not warrant uninterrupted service or guaranteed approval from third-party moderators.
12. Limitation of Liability
To the maximum extent permitted by law, PicPhoto and its officers, employees, and partners will not be liable for indirect, incidental, punitive, special, or consequential damages. Our aggregate liability for direct damages is limited to the fees you paid PicPhoto in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless PicPhoto, its affiliates, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of content you or your users upload, generated outputs, or misuse of the Service.
14. Governing Law & Dispute Resolution
These Terms are governed by U.S. law, without regard to conflict-of-law principles. If your order, invoice, or separate agreement specifies a jurisdiction, it controls; otherwise you agree to attempt informal resolution for 30 days, then submit unresolved disputes to binding arbitration located in California, USA, conducted in English. All claims must be filed individually—both parties waive participation in class actions.
15. Changes
We may update the Terms to reflect new features (for example, additional AI models or Solutions workflows). Material changes will be announced via email or in-product notices. Continuing to use the Service after updates become effective means you accept the revised Terms.
